1. Acceptance
Breaking Hundred Circle CIC Retreats (“BHC Retreats”), Breaking Hundred Circle CIC Fellowship (“BHC Fellowship”) are operated by Breaking Hundred Circle CIC (“BHC”). These terms and conditions, together with any description provided on our website or sales materials, form the agreement between you and BHC.
By booking a retreat ticket or enrolling for the fellowship, you confirm that you have read, understood, and accepted these terms and conditions.
2. Sussex Partnership Foundation Trust (SPFT) Staff Participation
2.1 Participants who are current employees of Sussex Partnership Foundation Trust (SPFT) acknowledge that their participation in the Retreat / Fellowship, hosted by BHC, is entirely voluntary, personal, and independent of their employment at SPFT. The Retreat/ Fellowship is not affiliated with or connected to SPFT in any professional capacity.
2.2 By attending/enrolling, participants agree that their involvement is separate from their professional role and relationship with SPFT. They further acknowledge that their participation will not influence or disadvantage or advance their employment status, professional opportunities, or working relationships within SPFT.
2.3 Participants expressly release and hold harmless Funmi Onamusi, BHC, and SPFT from any liability, perceived conflict of interest, or professional disadvantage resulting from their participation in the Retreat/Fellowship.
3. BHC Retreats/BHC Fellowship
3.1. Participants of BHC Retreats/ BHC Fellowship must be 18 or over.
3.2. An application by you to attend a Retreat or join the Fellowship is subject to written acceptance by BHC. BHC reserves the right to refuse an application for attendance.
3.3. To gain the most from the program, participants are encouraged to arrive promptly and attend all sessions in full.
3.4. If a participant’s conduct is deemed unacceptable (at BHC’s reasonable discretion), we reserve the right to request that they leave the program. No refund of fees will be made in such cases.
3.5. BHC reserves the right to change the program venue and make minor adjustments to the timing and content of any program. If we need to replace a speaker, we will ensure the replacement speaker has comparable expertise.
4. Fees
4.1. Deposits are non-refundable except as set out in Section 5 or if your application to attend a program is not accepted.
4.2. Upon acceptance of your application, you must pay the full program fee according to the payment plan before the program begins.
4.3. If fees are not paid by the due date, BHC reserves the right to reallocate your place. You will remain liable for the fees unless BHC is able to reallocate your spot, in which case a discretionary refund may be offered.
4.4. Any additional costs incurred, such as extra drinks, food, photocopying, or transportation, are your responsibility and are not covered by BHC.
4.5 The instalment option on any of our programs is provided solely to facilitate flexible payment. The full payment will be expected from you upon signing up for the retreat/fellowship.
5. Refunds and Cancellations
Retreats
5.1. Due to the nature of our retreats, refunds are not available.
5.2. Bookings are not transferable to another date for a different retreat. However, your reservation may be transferred if you find a replacement for the retreat you have paid for. Payment arrangements must be made directly between you and your replacement. If you share accommodation, this also applies, as the retreat cost is per individual and not per room.
5.3. BHC reserves the right to cancel a retreat at any time before its start. In such cases, we will refund any fees paid or offer a transfer to another retreat date. Note that BHC will not reimburse travel costs for cancelled retreats.
5.4. Refunds will not be granted for cancellations arising from circumstances beyond BHC’s reasonable control, although refunds may be offered at BHC’s discretion.
5.5. Changes to speakers or venues do not entitle participants to a refund.
Fellowship
5.6 Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most services bought online, you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these terms. How long do I have to change my mind? If you have purchased services, you have 14 days after the day we email you to confirm we accept your order.
5.7 You can always end your contract with us. If what you have bought is faulty or misdescribed, you may have a legal right to end the contract. If you have just changed your mind about the product, you may be able to get a refund if you are within the cooling-off period, but this may be subject to deductions of admin costs already incurred.
5.8 When you don’t have the right to change your mind. You do not have a right to change your mind in respect of the fellowship, once started even if the cancellation period is still running.
5.9 If you cancel after we have started the services, you must pay us for the fellowship as the program cost will have already been incurred by your place on the program and it is not possible to substitute half way through
5.10 When your refund will be made. We will make any refunds due to you as soon as possible. If you are exercising your right to change your mind then we will make the refund within 14 days.
5.11 We may end the contract if you break it. We may end the contract for a product at any time by writing to you if:
- You do not make any payment to us when it is due and you still do not make payment within 14 days of us reminding you that payment is due;
- You must compensate us if you break the contract. If we end the contract in the situations set out above we will refund any money you have paid in advance for products we have not provided but we may deduct or charge you reasonable compensation for the net costs we will incur as a result of your breaking the contract.
5.12 We may withdraw the product. We may write to you to let you know that we are going to stop providing the product. We will let you know at least 30 days in advance of our stopping the supply of the product and will refund any sums you have paid in advance for products which will not be provided.
6. Liability and Damages
6.1. BHC does not exclude liability for personal injury or death caused by its negligence.
6.2. Participants are responsible for their personal belongings, as BHC accepts no liability for loss or damage.
6.3. BHC is not liable for any loss or damage caused by events beyond its reasonable control.
6.4. BHC’s liability is limited to the fees paid for the relevant retreat.
6.5. Participants are responsible for their allocated rooms and liable for any damage caused to the property or equipment due to their actions or omissions. Any repair costs will be charged to the participant.
7. Feedback and Complaints
7.1. BHC aim to provide a high-quality and enjoyable experience. If you have a complaint, please email it to admin@breakinghundred.org within 7 days of the retreat’s conclusion. We take all complaints seriously and will respond within 28 days.
8. Data Protection
8.1 We will handle your data in accordance with BHC’s privacy policy. Your information will be used to contact you about retreat-related updates and for analysis to improve future retreats.
9. General
9.1. This agreement constitutes the entire agreement between you and BHC.
9.2. This agreement is governed by English law, and any disputes will be resolved in the English courts.
